研究概要

(1)研究の背景

地域経済発展のために,イノベーションが重要であるのは言うまでもないだろう.では,イノベーションを促進する要因はどのようなものなのだろうか. 経済学の標準的な見解によると,知的財産制度(特許・著作権)と競争を例として挙げる.つまり,イノベーションを引き起こした企業に独占的利用権を与えることで,もしくは,企業は競争に敗れるのを避けるために,研究開発インセンティブを高めるとする論理である.

このような論理は明快である一方で,複雑な現実の中で有効であるかどうかは不透明である.例えば,特許期間を延長する特許収入が増えるので,企業の研究開発投資を促しそうである.しかし,特許保有企業がその特許を自社に抱え込み,その技術分野の進展を阻害するかもしれない(Lerner, 2009 など). また,一つの市場に多数の企業が参入した場合に(これは激しい競争が起きている一つの経済学的指標である),全ての種類の投資が促進されるとは限らない. そこで本共同研究では,｢知的財産制度｣と｢競争｣の2つの要因からイノベーションの研究を進めてきた.以下では,この2つの要因ごとに研究成果を整理する.

(2)研究の実績と成果

知的財産制度とイノベーションについて

知的財産制度がイノベーションを阻害する論理として,本共同研究で注目したのは既存研究で指摘されている Sequential innovationと Legal Action という2つの仮説である.Sequential innovation 仮説とは,「基礎技術と応用技術という技術的遂次性が存在する時に基礎技術の独占的利用が強まると,応用分野の研究開発投資が抑制される」というものであり,Legal Action 仮説とは「知的財産がより強く保護されると,既存特許の利益を維持しようとし,新規の研究開発投資が抑制される」というものである.

本研究では両仮説を含むモデルを構築し,理論的に検証した.その結果,｢知的財産制度の強化によって,前者の仮説では特許権を持っていない企業の研究開発投資が減少するのに対し,後者の仮説では特許権を持っている企業の研究開発投資が減少すること」という両仮説の違いを明らかにした.我々はこの含意の違いは重要であると考えている.なぜなら,この結果はイノベーションを阻害している原因を探る実証研究の手がかりになり,ひいては,知的財産の制度改革の方向性を決めるものとなる可能性があるからである.

として公開し,法と経済学会や Second Asia-Pacific Innovation Conference などで研究報告した.

競争と企業の投資活動について

競争が企業の投資活動に与える影響について,本共同研究が注目したのは,市場を拡大するような投資である.例えば,携帯電話会社による Wi-Fi 基地局の追加は自社の需要を増やすだけではなく,その利便性の向上によって市場全体の需要を拡大する.このような投資を考えると,参入企業数の増加という意味での競争の激化は必ずしも社会的に望ましいものとは言えなくなる.投資の他社へのスピルオーバーが存在する状況では,企業数の増加は投資の限界的収益を減らし,投資インセンティブを低下させてしまうからである.つまり,競争が企業の投資活動を抑制する効果を持つのである.

更に,第三セクターや部分的な民営化が行われた公営企業などの準公営企業の存在が上記の問題をどのように変化させるかを検討した.主要な結果は,(1)準公営企業が投資を行うインセンティブは,私企業の数に関係なく私企業よりも大きい,(2)民営化の程度が大きい準公営企業が市場に存在する場合,私企業数の増加は上記の投資の総量を減少させる.である.したがって,私企業にゆだねるよりも,準公営企業存在した方が望ましい場合があることが分かった.

としてまとめ, Midwest Economic Association Annual Meeting 2013 や日本経済学会秋季大会などで報告した.

(3)今後の展望

上記の研究は,伝統的な産業組織理論をフレームワークに従ってイノベーションに影響のある経路を分析した.この研究は2つの方向で進展が望めると我々は考えている. 一つは,企業が一枚岩であるという仮定を修正することである.企業内のイノベーションの発生プロセスを考えると,企業は従業員を処遇する様々な制度を導入し,従業員は共同作業を通じてイノベーションを生み出す.このように,企業と従業員を区別すると,「これらの制度がイノベーションにどのように影響を与えるか」という興味深い課題が現れる.実際,研究期間に二種類の準備的検討(1)組織内の効率的な意思決定構造やインセンティブシステムの理論研究,(2)第3セクターの効率性の実証研究,を実施している(計11回の研究報告を行った).

もう一つは,複数の企業が特許を相互利用するパテント・プールや,合理的なライセンス料で特許利用を認めるランド宣言など,企業間の多様な取り決めにも注目することである.これらが日本に限らず世界的に広がりを見せていることを鑑みると,「これらの取り決めが技術の効率的利用にどのような影響を与えるか」という問題も現実的な課題であるだろう.

研究期間は終わるが,今後も,現実に生じているこうしたプロセスと要因の複雑な糸を解きほぐしながら,イノベーションの影響要因を明らかにしていきたいと考えている.
